Saadat, the parties were unable to close the closing date set in a GSP. However, what is the legal situation in which the buyer finds itself if the seller notifies the buyer on July 31, 2021 that it will not deliver bushels of corn to the buyer by August 31, 2021 or at any time? What can the buyer do, if any, if the seller has informed him? Does he have to wait until August 31, 2021 to confirm that the seller did not act as agreed before he can sue the seller?
