THE DATA COMES FROM SOURCES THAT LICENSOR AND DATA PROVIDERS GENERALLY BELIEVE TO BE RELIABLE, BUT NEITHER LICENSOR NOR DATA PROVIDERS NOR THEIR RESPECTIVE SUPPLIERS OR AFFILIATES WARRANT THE ACCURACY OR COMPLETENESS OF THE DATA AND HEREBY INFORM YOU THAT INTERRUPTIONS, INACCURACIES, ERRORS AND OMISSIONS OCCUR AND WILL OCCUR FROM TIME TO TIME. NEITHER LICENSOR, NOR DATA PROVIDERS, NOR ANY OF THEIR RESPECTIVE SUPPLIERS OR AFFILIATES ACCEPT ANY LIABILITY FOR ANY INTERRUPTION, INACCURACY, ERROR OR OMISSION, HOWSOEVER CAUSED, OR FOR ANY LOSS SUFFERED BY YOU AS A RESULT. The use of automated query systems to access data is strictly prohibited. Any use of these systems will result in the immediate termination of access. You further understand and agree that your right to receive all or part of the Data will terminate to the extent that Licensor`s agreements with any of the Data Providers terminate for any reason or a Data Provider refuses or for any reason is unable to continue to provide Data (in whole or in part) to Licensor. If this happens, it may be done without notice and in no event will it give rise to any liability to the Licensor or any of the Data Providers or any of their respective affiliates or will it change your payment obligations. To the extent possible, you agree to provide written authorization or agreement with each exchange to the extent required by the rules, regulations or guidelines of such exchange to obtain data from such exchange. You also agree to comply with all applicable conditions, restrictions and restrictions and to pay all applicable fees and costs imposed by such exchange. (a) Licensor grants you a non-exclusive license to use the Software included in the Subscription (as defined below), which includes all investment and simulator trading tools and applications included in the Subscription (the “Software”), as well as all market and other financial, news and other financial, market and/or commercial information contained in the Subscription (the “Data”) on a single computer terminal (to any time). If the software or data is used on a network, each person accessing the software or data on the network must have or be subscribed to separate software and data license for that person (i.e., there must be one subscription per person). If you license the Software and Data on a monthly, annual or periodic basis, under a subscription, rental or similar agreement with TopstepTrader (the “Subscription”), your right to use the Software and Data, unless renewed, will terminate upon expiration of your subscription and may be terminated immediately if you fail to make the required payment or breach any of your other agreements with Licensor. any data provider or exchange of market data (“Exchanges”) listed in or relevant to your subscription or this Supplement, whether set forth in this Supplement or elsewhere. This Supplement and the license granted may not be transferred, assigned, leased, leased, sublicensed or otherwise transferred by you. Under no circumstances may the software or data be used by you for or in connection with illegal purposes. You agree that Licensor and its affiliates may use and share information about you and your subscription with data providers and other service providers in accordance with applicable laws, this Supplement and the Privacy Policy of Licensor and its affiliates. Licensor and its affiliates may obtain and use this information for marketing and promotional purposes, as well as for other legitimate business purposes. This is a legal agreement (“Supplement”) that supplements the Terms of Use (the “Terms of Use”) between TopstepTrader, LLC, an Illinois limited liability company (“TopstepTrader”), and TopstepTrader account holders (“you” or “your”) if you have chosen to use the TradeStation software platform® for the TopstepTrader Trading Combine. All capitalized terms used but not defined in this Supplement shall have the respective meanings ascribed to them in the Terms of Use. As used in this Supplement, “Licensor” means TradeStation Technologies, Inc., a Florida company, and (ii) “Data Providers” means Licensor`s data providers and any stocks, options, futures or other exchanges or suppliers whose data is distributed or redistributed to you directly or indirectly by Licensor. By creating an account with TopstepTrader and choosing to use the TradeStation software platform for the TopstepTrader Trading Combine, you agree to be legally bound by the terms of this supplement. You understand and agree that this Supplement has the binding legal force and effect of a contract signed in ink and delivered in person. In the event of any conflict between this Supplement and the Terms of Use, this Supplement shall apply. You acknowledge and agree that Licensor is a third party intended beneficiary of this Supplement and has the right to enforce each provision of this Supplement directly against you. Your subscription does not entitle you to any upgrades or technical support that Licensor or any of its affiliates offer or offer from time to time. All support services, including technical support and other services, relating to the Software and Data are provided solely by TopstepTrader. The Walk Forward optimizer provides an easy-to-read pass/fail report to help you decide if a strategy is ready to be implemented in a live market. And of course, you can always try an idea in your paper trading account to see how it behaves in a live market before risking real money.
THIS SUPPLEMENT DOES NOT COVER OR RELATE TO THE OPENING OF A BROKERAGE ACCOUNT OR BROKERAGE SERVICES OR TRANSACTIONS OF ANY KIND. ALL MATTERS RELATING TO BROKERAGE SERVICES AND TRANSACTIONS USING THE TRADESTATION SOFTWARE PLATFORM ARE GOVERNED BY AGREEMENTS BETWEEN YOU AND TRADESTATION SECURITIES, INC. COVERED (LICENSOR`S BROKERAGE SUBSIDIARIES ARE COLLECTIVELY REFERRED TO HEREIN AS “BROKERAGE AFFILIATES”). If any of the data providers providing data ceases to provide it in a manner consistent with the Software or any receiving/transmitting device software, Licensor may terminate the inclusion and delivery of so much affected data in the subscription without notice, without any liability to you and without altering your payment or other obligations. In addition, the Software (which determines, among other things, the functionality and appearance of most, if not all, of the features of the Subscription) may be modified or replaced from time to time, in whole or in part, without notice and without liability to you, and without any change in your payment or other obligations. Keep in mind that many non-stock trades incur additional exchange fees for clearing and trading. Financial scholarships (e.B. CBOT, CME, NYMEX/COMEX, CFE, etc.) set these fees, which vary depending on the market and the level of your exchange membership.
